01Who these terms cover

These terms apply to all photography, videography, editing and related services provided by SHOT BY 610 MEDIA LLC. "Client" or "you" means the person or business booking the work. "Work" means all footage, photographs, edits, exports and deliverables I create, in every format. Booking a shoot, paying a deposit, or approving a quote means you accept these terms. Where a signed project agreement exists and says something different, that agreement wins.

02Booking and deposits

A date is only held once a non-refundable deposit of 50% of the agreed fee has cleared. Until then the date stays open to anyone else. The deposit is applied against the total. The remaining balance is due before final files are delivered. If a deposit is not paid within 7 days of the quote, I may release the date without notice.

03Payment and late fees

Fees are quoted in US dollars and exclude any applicable tax. Invoices are due on receipt unless the quote says otherwise. Balances unpaid 14 days past due may accrue a late fee of 1.5% per month on the outstanding amount, applied from the original due date. I may pause work and withhold delivery of any files while an invoice is outstanding. Reasonable costs of recovering unpaid amounts, including collection or legal fees, are payable by you.

04Cancellation and postponement

Deposits are non-refundable in all cancellation scenarios, because holding your date means turning other work away. Cancel more than 30 days before the shoot and you owe nothing beyond the deposit. Cancel within 30 days and 50% of the remaining balance is due. Cancel within 7 days, or fail to show, and the full balance is due. One postponement is permitted at no charge if requested more than 30 days out and a new date is agreed within 60 days, subject to my availability; a second postponement is treated as a cancellation. If I cancel for any reason other than your breach, you receive a full refund including the deposit, and my liability is limited to that refund.

05Scope, coverage and overtime

The quote defines the scope: shoot hours, locations, deliverables and number of edits. Coverage begins at the agreed call time and ends at the agreed wrap time. Time beyond that is billed in 30-minute increments at my standard overtime rate, payable with the final balance. Adding locations, shoot days, deliverables, formats or subjects after the quote is approved is new scope and will be re-quoted.

06Your responsibilities on the day

You are responsible for securing location access, permits, parking and power where required, and for providing a single point of contact who can make decisions on the day. Delays caused by late arrivals, unavailable subjects, denied access or missing permissions count against the booked coverage time and are not refundable. You confirm you have the right to be at every location and to have it filmed and photographed.

07Creative control

I am engaged for my creative judgment. Framing, lighting, shot selection, edit pacing, color and final grade are mine to determine. I welcome references, mood boards and direction, and I will always work toward your goal, but dissatisfaction with my style is not grounds for a refund. Review my portfolio before booking so the look is what you expect.

08Revisions

Two rounds of revisions are included on the first cut unless the quote states otherwise. A round means one consolidated set of notes, collected and sent together. Notes that reverse a previously approved decision, change direction, or add scope are billed at my standard hourly rate. Additional rounds beyond those included are billed hourly. Once final files are delivered and the project is marked complete, further changes are a new project.

09Delivery and file storage

Delivery timelines are estimated in the quote and start from the shoot date or from receipt of everything I need from you, whichever is later. Final files are delivered digitally via download link. You are responsible for downloading and backing up your files promptly. I keep project files on my systems for 90 days after final delivery as a courtesy, not as an archive service. After that they may be deleted permanently. Recovery after that window, where possible at all, is billed as a new job.

10Copyright and usage rights

I retain copyright and full ownership of all Work at all times. This is standard practice and is not negotiable except by separate written agreement. On payment in full, you receive a non-exclusive, perpetual, worldwide license to use the delivered final files for the purposes described in the quote. Unless the quote says otherwise, that license covers your own organic social media, your website and your internal use. It does NOT cover paid advertising, broadcast, out-of-home, resale, sublicensing or distribution to third parties. Those uses require a separate written license and additional fee. You may not sell, relicense or transfer the Work to anyone else. You may not recut, crop, re-grade, filter or add elements to the final files in a way that materially alters them without my written approval. Raw and unedited footage, outtakes and project files remain mine and are not delivered unless separately agreed and paid for.

11My right to show the work

I retain the right to use the Work in my portfolio, showreel, website, social media, awards submissions and marketing, and to display it in perpetuity. If your project is sensitive or under embargo, tell me in writing before the shoot and we will agree a hold period or exclusion in advance.

12People, releases and permissions

You are responsible for obtaining consent from everyone appearing in the Work, and for informing them that the material may be used commercially and in my portfolio. If a minor appears, you are responsible for obtaining parent or guardian consent. You confirm that any brands, logos, artwork, venues, products or locations you ask me to feature are cleared for that use.

13Music and third-party material

Any music, footage, images, fonts or other material you supply or request must be properly licensed by you. You are responsible for those licenses and for any claim, takedown or damages arising from them, and you agree to indemnify me in full for any such claim. Where I supply music, it is licensed for the specific use described in the quote only. Using a delivered piece beyond that licensed use, including running it as a paid ad when the music was licensed for organic use, is your responsibility, not mine.

14Things outside my control

I will not be liable for failure or delay caused by circumstances beyond my reasonable control, including weather, illness, injury, accident, traffic, venue or authority restrictions, third-party interference, power loss, or acts of God. If I cannot attend for such a reason, I will make reasonable efforts to arrange a suitable replacement or reschedule; if neither is possible, my liability is limited to a refund of amounts paid for the affected work.

15Equipment, data and liability

I use professional equipment and follow standard backup practice, including recording to redundant media where the camera supports it. In the rare event of equipment failure, card corruption, theft, or data loss occurring despite reasonable care, my total liability is limited to a refund of the fees paid for the affected portion of the work. To the maximum extent permitted by law, I am not liable for indirect, incidental, special or consequential damages, including lost profits, lost opportunity, or the cost of re-staging an event. My total aggregate liability under any project will not exceed the total fees actually paid to me for that project.

16Travel and expenses

Southwest Florida is home base and local travel is included. Work beyond the local area may include travel, mileage, accommodation, per diem, parking, tolls and permit costs, quoted in advance. Where travel is booked on your behalf and you later cancel, non-refundable travel costs already incurred remain payable by you.

17Conduct and safety

I reserve the right to stop work and leave without refund if I, or anyone assisting me, is subjected to threatening, abusive, discriminatory or unsafe behavior, or if a location becomes unsafe. In that situation the full balance remains payable.

18Privacy

Information you submit through the contact form on this site is used only to respond to your enquiry and manage your project. It is not sold or shared with third parties except where necessary to deliver the work or where required by law. Contact bookings@shotby610.com to request deletion of your details.

19Disputes

Before starting any formal action, both parties agree to attempt to resolve the matter in good faith by direct discussion. Most problems come from a misunderstanding about scope or usage, and a conversation usually settles it faster and cheaper than anything else. If any clause in these terms is found unenforceable, the rest remain in force.

20Changes to these terms

These terms may be updated from time to time. The version in effect on the date your deposit is paid is the version that governs your project. Questions about anything on this page can go to bookings@shotby610.com. I would rather explain it up front than argue about it later.
